Constructive Dismissal

Constructive dismissal can occur when the employer engages in conduct that makes the employee's working conditions so intolerable that they are left with no choice but to resign. This can include actions such as bullying, harassment, discrimination, or a breach of an employment contract.

To be classified as constructive dismissal, the working conditions must be so bad that a reasonable person in the same situation would have also resigned. We recommend raising this with your employer before resigning if possible.
